Italian museums can be directed by foreigners. Council of State puts an end to litigation

End of litigation over museum directors: the Council of State rules that the position can also be filled by foreign directors.

The long dispute over foreign directors comes to an end after more than a year: it took two rulings by the Tar and three by the Council of State to establish that the appointments of Dario Franceschini, who had put as many foreign directors in charge of seven Italian museums in 2015, were legitimate. First the rejection by the Lazio Regional Administrative Court, which in two rulings had upheld the appeals of two candidates in the great 2015 competition (Giovanna Paolozzi Strozzi and Francesco Sirano) and had decreed the annulment of five out of 20 appointments, then the MiBACT’s appeal to the Council of State, and then the rulings of the Council of State, which had referred the decision to the Plenary Assembly: the latter ruled yesterday, establishing that Presidential Decree No. 174 of 1994 (the one stipulating that public managers must have Italian citizenship) is in irremediable conflict with European law, and therefore cannot be applied. So, green light to foreign directors, who can now continue to do their jobs without worry.

Former Minister Franceschini, via Twitter, expressed full satisfaction with the outcome of the dispute: “After years of appeals and rulings, the affair of foreign directors in museums is definitively closed with today’s green light from the Council of State. Thanks to all the Italian and foreign directors who will now be able to continue their extraordinary work.”
